16.8 Delayed attachment by agreement

16.8.1

The grantor and the secured party can agree to delay attachment of a security interest to a later time if they wish1. The parties may wish to do this to avoid breaching a restrictive covenant such as a negative pledge clause against the grant of further security which the grantor may have undertaken for the benefit of another secured party, until an appropriate waiver of that covenant can be arranged.
