The PPSA applies to all security interests granted over personal property by individuals, so the privacy of individuals becomes an issue. The PPSA expressly acknowledges that unauthorised searches of the PPS Register against individuals constitute a breach of privacy of an individual1.
The PPSA restricts the searches that may be conducted in respect of grantors who are individuals. The PPSA sets out an elaborate scheme for when particular searches may be made in respect of individual grantors in section 172. Searching against an individual grantor in contravention of section 172 is prohibited, and carries a civil penalty2.
