22.19 Defective registrations

It is imperative to register the grantor’s details correctly. Except for consumer serial numbered property and commercial aircraft (which must be registered by serial number), a search on the grantor only must reveal the security interest, otherwise the registration is defective1.

For serial numbered property that must be registered by serial number (all consumer serial numbered property, and commercial aircraft), a search against the serial number only must reveal the security interest, otherwise the registration is defective2. The serial number must be correct. Secured parties should register, then search again to check that any serial numbers recorded on the PPS Register are correct. Recall that commercial (non consumer) serial numbered property other than commercial aircraft may be (not must be) registered by serial number. A registration against an incorrect serial number will not make a security interest over this property defective.
